Terms and Conditions of RightPrice Carpets & Furniture Limited

(RightPrice)

These terms and conditions do not affect your statutory rights.

 

If any of these Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of Northern Ireland, then to the extent and within the jurisdiction in which that Condition is illegal, invalid or unenforceable, it shall be severed and deleted from the Conditions and the remaining Conditions shall survive, remain in full force and effect and continue to be binding and enforceable.

 

  1. Order Lead Time

Any Order delivery date quoted is an estimate.  We will make every effort to keep to the quoted date but it is possible that circumstances beyond our control may cause delivery dates to change.  If such a change does occur, we will inform you of the new estimated date of delivery.  RightPrice have a grace period of 5 weeks outside the quoted delivery date before cancellation of the order can occur.

Estimate lead times are as follows:

  • Beds                                                 3-5 weeks
  • Flooring                                            3-5 weeks   
  • Suites                 Soft Cover              6-8 weeks

                                    Leather Cover        10-12 weeks

  • All Other Ranges                               8-10 weeks

 

2. Storage

 

It is our policy to attempt to deliver all goods to you as quickly as possible. Therefore, we would expect you to assist in arranging a mutually suitable delivery date. We appreciate that not all goods can be delivered immediately and therefore, we will store goods for up to a period of 2 weeks.  After that, we will only continue to store the goods for another 6 weeks as long as they are fully paid for.

 

Any additional storage time will be charged at a rate of £10.00 per item per week until delivery is made.

 

This will not apply where a product is available earlier than the lead time indicated at point of sale or where you have specifically stipulated a 'Not before by date' when ordering the goods.

 

3. Place and time of Delivery

 

We only offer free delivery to Northern Ireland.  Any other area will incur a charge which will be decided at our discretion depending on location.

 

We regret that we are unable to give a specific time for delivery but will try to inform you as to whether it will be morning or afternoon.  In the event of our failure to deliver due to unforeseen circumstances, we will contact you immediately.

 

It is our responsibility to ensure that the goods are delivered to the entrance of the premises indicated at the point of sale.  It is your responsibility to ensure that the product can be delivered into your home and chosen room.  Therefore, you should keep in mind issues such as vehicle access, tight stairs and narrow corridors when ordering your furniture.  If windows or doors need to be removed to allow access for RightPrice staff to deliver the furniture, it is your responsibility to arrange this at your cost and risk.  All items such as televisions, pictures, stereos, ornaments etc should be removed from any area where our delivery men or fitters may have occasion to be. If access at time of delivery is not safe, then the goods will be returned to Right Price until such a time that it is safe.  If delivery is not possible due to unsuitable access a 25% cancellation charge is applicable.  Right Price will also not accept responsibility for the breakage or damage to any items which should have been removed from the area.

 

If requested, RightPrice staff will strip and remove rubbish and build items where necessary.  However, we are not responsible for disposal of old furniture, carpet or other such goods.

 

We expect our staff to exercise a reasonable standard of care when delivering goods.

 

4.  Flooring – Room measurements/Damp tests

 

RightPrice offer a free measuring service within the Northern Ireland area.  Any measurements taken remain the property of RightPrice and will not be distributed to the customer.

 

If the customer declines to use this service and provide their own measurements, they accept full responsibility for the flooring once it is ordered or cut.  If the measurements are wrong, the consumer will bear the cost of correcting their mistake.

 

Damp tests are also provided when certain types of flooring are to be fitted, including wooden floors, seagrass, coir and laminate flooring.  We have certain guidelines which we follow when doing damp tests and will only fit flooring when these are met.  Therefore, we will, under no circumstances, fit certain types of flooring in a house which is under 6 months old.  If the consumer insists on the flooring being fitted despite our advice, we will ask them to sign a letter stating that they will be responsible should any issues occur due to dampness.

 

If we take damp readings and the consumer decides to use their own fitter, the readings which we gave you are no longer valid and cannot be used as a basis for fitting the floor.  We will not accept any liability should you continue to use the readings and a fault occurs due to dampness in the floor.  The readings which we took were for our use only and therefore, you are advised to take your own readings before proceeding to fit the flooring.

 

 

5.  Flooring – Fitting

 

Fitting can either be paid directly to RightPrice or to a separate sub-contracted fitter.

 

If payment is made directly to RightPrice, we will accept responsibility for the fitting and any issues arising from it.

 

If payment is made direct to the fitter, a separate contract is established.  It is then the responsibility of the consumer to guarantee the quality of workmanship and to arrange payment for work.  Non-completion of fitting or unsatisfactory workmanship is not a valid reason for withholding payment for materials from RightPrice.  An amount will be marked that the consumer should pay to the fitter but this is an estimate and the final figure should be negotiated between the consumer and fitter.

 

The consumer must ensure, at the time of fitting, that the correct flooring is being installed in the correct area.  If the consumer or their representative is not available, RightPrice cannot accept responsibility for flooring fitted in the wrong area.  We can make arrangements to collect keys and arrange fitting when no one is present, but ultimate responsibility lies with the consumer.  The consumer must ensure that all old flooring is uplifted and the floor brushed in preparation for fitting.  Work may be delayed and a charge levied should RightPrice have to arrange this.

 

6.  Beds – Mattresses

 

Beds/Mattresses cannot be exchanged once delivered to your home in the interests of hygiene unless there is a manufacturing fault.  Tension of mattresses can be tested in the store before a purchase is made.

 

7.  Colours and Finishes

 

Carpets/Flooring

Shading is a natural occurrence in all cut pile carpets and as such, it is not recognised as a manufacturing fault.  Therefore, no claim will be accepted by RightPrice against a carpet experiencing this phenomenon.

 

Solid Wooden Flooring

Wooden flooring is susceptible to colour variations.  The samples in the shop are only an indication of the colour and consumers should be aware that variations could occur in the wood which they actually receive.  These variations are not recognizable manufacturing faults and RightPrice will not accept any such claims.

 

 

Furniture

Photographs on our website and display models and samples in our store are representative of the finished product.  Every effort will be made to match all colours and finishes.  However, it must be recognised that slight dye, shade or grain variations can occur, especially with natural products such as wood, leather or wool.  Leather products are made from top quality hides and as such may not be uniform in colour and could be subject to natural marks and scars.  None of these issues are recognised as manufacturing faults and again no claim can be made against RightPrice for these natural occurrences.

 

8.   Guarantee/Warranty

 

All goods supplied are guaranteed for a period of 12 months from date of delivery to RightPrice in respect of faulty workmanship or materials.  However, any delivery damages must be reported to the complaints manager within 5 days after the date of delivery or the items will be deemed to have been accepted in good condition.

After 12 months, we will inspect any complaint for up to a further 4 years.   Any remedial work carried out is at our discretion.  If a replacement is deemed necessary then the consumer is liable as follows:

  • 20% of replacement cost in year 2
  • 40% in year 3
  • 60% in year 4
  • 80% in year 5.

 Your statutory rights are unaffected.

Please note that this warranty is only valid if the damaged goods are still in the place of delivery.  If the goods have been moved to another house or area, then Right Price will only uphold the warranty at the discretion of a director.

 

9.  General care

 

Many of the goods supplied will come with care and maintenance advice from the manufacturer.  This advice should be read and followed at all times when caring/cleaning the goods.  No responsibility will be accepted for damage caused by cleaning if the care and maintenance instructions have not been followed.

 

All mattresses will contain manufacturing instructions as to how often they should be turned and how this should be carried out.  No mattresses will be found to be faulty if it has not been cared for properly.

 

 

10.  Terms of payment

  • A minimum of 25% deposit will be taken at the time of entering into an agreement or before delivery.
  • Unless you have entered into a separate credit agreement, payment of the balance of your order should either be made before the order is delivered or as cash on delivery.
  • At our discretion, payment can be on account.
  • Account payments are 90 days maximum, after which any outstanding amounts will be passed to our debt collection agency.
  • Accounts over 90 days will be subject to debt collection fees and entered at 1% over base on a monthly basis.
  • As goods are meant to be paid before delivery and account payments are at our discretion, a service issue is not a reason to withhold payment.

 

11.  Cancellation of order

 

Stock items

Stock items can be cancelled at any time as long as it has not be cut or amended in any way. 

 

 

Special order items

These items have been ordered specifically for you and as such can only be cancelled as long as we have not received the order acknowledgment from the supplier.  Once we have received this, we have entered into a legally binding contract with the supplier and would be liable for the cost of the goods.

 

Cancellation is possible if it is found that RightPrice have misled you with regards to product specification or the item is found to be faulty.  Orders can also be cancelled if the goods are outstanding more than 5 weeks over the estimated delivery date referred to in Note 1.

 

Cancellation at any other time, prior to delivery, is subject to a 25% cancellation charge.

 

 

These terms and conditions can only be amended or altered with the authorization of a director of the company and must be signed.
